Bermuda Accredited Certificates

QuoVadis is an Authorised Certification Service Provider under the Bermuda Electronic Transactions Act (ETA), approved to issue Accredited Digital Certificates for legally binding digital signatures under Bermuda law.

Bermuda was one of the first countries in the world to enact e-commerce legislation when the Electronic Transactions Act was adopted in 1999. The ETA is based on international Model Laws which lay out security requirements for online data and transactions to have the same support under law enjoyed by their traditional paper-based equivalents.

In addition, the ETA is crucial to meeting the requirements for authentication, records retention, data integrity, and signature found in other laws and regulations. It achieves this by addressing the manner in which:

  • Online users are reliably identified and signatures used to attest to their intent; and
  • Electronic records and transactions are reliably generated, stored, or communicated.

The ETA defines an Electronic Signature as a measure that:

  • is uniquely linked to the signatory;
  • is capable of identifying the signatory;
  • is created using means that the signatory can maintain under his sole control; and
  • is linked to the information to which it relates in such a manner that any subsequent alteration of the information is revealed.

While those requirements could be proven to be met in by many different technologies and processes, the ETA defines a clear legal benefit for electronic signatures that are created using Accredited Digital Certificates that:

  • associate a secure signature creation device (SSCD) to a person;
  • confirm the identity of that person; and
  • are issued by an Authorised Certification Service Provider (CSP).

The Bermuda CSP authorisation provides independent verification of the service provider’s compliance with a stringent code of practice and security guidelines.  The CSP standard includes elements of ISO 17799 (now ISO/IEC 27002, Code of Practice for Information Security Management), EESSI (European Electronic Signature Standardisation Initiative), and WebTrust for CAs. 

In addition to serving as a Qualified CSP in multiple European jurisdictions, QuoVadis is currently the only Bermuda Authorised CSP.
